DELIVERY

CHILLING PLATE
Chilling plates are special devices that are produced on demand every time someone places an order to guarantee their quality and excellent performance. When placing the order by phone or by email, you will receive an order summary by email with the account number and the amount to be transferred. (Note that until the full payment is received to the current account of BJAO INSTRUMENT S.L. your order will not be managed).
Possible exchange and bank commissions are borne by the client.

PRICES
The purchase prices in force at the time the order is placed are those that appear on the screen, except for typographical errors. BJAO INSTRUMENTS, S.L. reserves the right to modify prices.
The installation or assembly of the products is not included in the price of the product.
The prices will indicate the Value Added Tax (VAT).
All prices are expressed in Euros (€) and are expressed without taxes.
In Spain, the Value Added Tax (VAT) will be applied with the exception of the Canary Islands, Ceuta and Melilla (in these territories, customs clearance expenses and import taxes will be borne by the client).

WITHDRAWAL OF ORDERS
The client will have a maximum period of fourteen (14) calendar days from the delivery of the product to withdraw, totally or partially, from the purchase of the product, in accordance with the applicable legislation.
Once the period of fourteen (14) calendar days has ended, BJAO INSTRUMENTS, S.L. will not accept returns for withdrawal of purchases of Products.
The client will not have the right to withdraw in the cases established in the applicable regulations and, especially, with an illustrative and non-limiting nature, in the following cases: (I) Products made according to the client’s specifications, clearly personified or whose manufacturing parts have been ordered exclusively for the manufacture of the product; (II) For hygiene and health reasons, BJAO INSTRUMENTS, S.L. restricts returns of hygiene products, products likely to come into contact with the skin, food products and products that have been unsealed after delivery, therefore, their return will not be accepted; (III) Products that at the time of purchase show a delivery period other than “approximate delivery period of 24 to 48 hours”. In these cases it is understood that it is a product purchased on demand and BJAO INSTRUMENTS, S.L. reserves the right not to accept their return.
The procedure to exercise a return will begin with the client’s request by opening a transaction through the contact details of the Customer Service Department that appear on the website and sending it to BJAO INSTRUMENTS, S.L., the customer service department. will give you an answer within a maximum period of 48 hours from the receipt of the request, assigning return instructions if applicable.
Once the authorization has been received by the client, they can make their return within seven (7) days from the notification of withdrawal to BJAO INSTRUMENTS, S.L., sending us the product (indicating the assigned return number on the shipping package). ) to the following address: Calle Mallorca, 326, 08037 Barcelona.
BJAO INSTRUMENTS, S.L. will check the adequacy of the returned product in its warehouse, reserving the right not to make the refund if it detects that the purchased product is not received in perfect condition. Take special note that BJAO INSTRUMENTS, S.L. will verify the merchandise when it arrives at our facilities and that in no case is it responsible for possible damages caused by transport companies not contracted by BJAO INSTRUMENTS, S.L.
In the event that it is desired that BJAO INSTRUMENTS, S.L. manage a collection of the merchandise, you must: contact our customer service department, send us photographs of the material to be returned before and after packaging to verify that the material is in perfect condition before it is collected by the transport company . In these cases (and for goods up to 40 kg or 0.3 m3 in volume) BJAO INSTRUMENTS, S.L. The amount of €15 + VAT plus 1.5% of the amount of the merchandise will be deducted from the amount to be returned as full-risk insurance. For goods with more volume or greater weight, consult the return rates.
It is mandatory that you keep the original box of the merchandise during the withdrawal period. BJAO INSTRUMENTS, S.L. reserves the right not to accept the return without the original box of the product. However, if accepted, this will mean a decrease in the value of the product, which may become zero.
BJAO INSTRUMENTS, S.L. will manage the refund of the amount of the returned goods through the same payment system used by the client to purchase the products. The shipping costs to the customer of the abandoned products will be deducted from the return. Nor will any additional cost of shipping, or cash on delivery, or installation and start-up costs, if any, be returned. Payments will be made in EUROS.
WARRANTY
The guarantee of the products sold by BJAO INSTRUMENTS, S.L. is provided and established by virtue of the regulations contained in current legislation, in particular, in the aforementioned R.D. 1/2007, article 114 and following, legal framework that aims to provide the consumer with different options to demand sanitation when the purchased good is not in accordance with the contract, giving him the option of demanding the repair or replacement of the good, unless one of these is impossible or disproportionate. When repair or replacement is not possible or is disproportionate, the consumer may demand a price reduction or termination of the contract.
In case of lack of conformity of the product, a period of two years is recognized for consumers and a period of one year for professionals and freelancers, from the moment of delivery so that the buyer can make their rights effective. However, only in the 6 months following the delivery will it be presumed that the lack of conformity already existed at the time of the same, corresponding to the buyer to prove that the good was non-conforming, in accordance with article 114 and following of the R.D. 1/2007. The consumer must inform BJAO INSTRUMENTS, S.L. of the lack of conformity within a period of two months from when he became aware of it.
After the first 6 months from the invoice date, the equipment for repair must be sent carriage paid by the customer. BJAO INSTRUMENTS, S.L., reserves the right to verify that the defect has been caused by a manufacturing fault or misuse. If the product is under warranty, BJAO INSTRUMENTS, S.L. will pay the customer the postage paid and the return to the customer will be the responsibility of BJAO INSTRUMENTS, S.L. If the product is not under warranty, the customer will have to pick up the product at the cost of transportation. Consumable parts such as batteries, cables, batteries, light bulbs, fuses, etc. They are not included in the guarantee together with accessories.
During the repair or review period, the company will not replace the product and will not imply any compensation.
BJAO INSTRUMENTS, S.L. reserves the right to carry out a verification of the origin of the problem. In the event of a defect caused by misuse, the repair will be billable.
To make use of the guarantee, it will be necessary to notify our after-sales service department in advance, not being accepted in our warehouses any merchandise that has not been previously authorized to be exchanged, returned or repaired.
The guarantee is addressed only to the holder (contractual party) that appears on the invoice and only the holder may demand it.
The guarantee will lose its value:
- If any of the data on the same or on the proof of purchase are modified, altered or replaced.
- If the guaranteed device itself is manipulated or repaired without the knowledge of the Technical Service.
- If you don’t have an invoice.
- In case of power surges or connection to an inappropriate voltage.

ORDER CANCELLATION
The cancellation of an order processed by the client, in the manufacturing or import process will entail covering all expenses such as transport, customs expenses, etc.
BJAO INSTRUMENTS, S.L. reserves the right of admission and cancellation of any order, being able to return the amount paid by the client and being exempt from any other obligation.
DATA PROTECTION
In accordance with Organic Law 15/1999 (LOPD) of December 13 and with Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, we inform you that your data will be incorporated into our file (Customers), which has been notified in the General Data Protection Registry, in order to allow existing commercial procedures and/or the sending of advertising and offers for our products, provided that you do not express your opposition.

SALE CLAUSES
The medical devices purchased will only be used by qualified and properly trained professionals, depending on the product in question. The products must be used under the conditions and according to the purposes provided by their manufacturer. APPLICABLE LEGISLATION AND JURISDICTION
The sales carried out are subject to Spanish legislation. In the event of any conflict or discrepancy in the interpretation or application of these contractual conditions, the Courts and Tribunals that will hear the matter will be the Courts of the judicial district of Barcelona (Barcelona).
